Terms & Conditions Of Online Sales
The customer agrees to be bound by this sale agreement and accepts its terms and conditions
Formation of Contract The contract is formed only when the goods are dispatched by the seller.
Consumer Guarantees Act 1993 Where the buyer is acquiring the product for the purpose of business, or if the product is shipped to a destination not in New Zealand, then the NZ Consumer Guarantees Act 1993 shall not apply. In the event the buyer is acquiring the product for purposes other than that of a business, and if the product is shipped to a New Zealand address, then these conditions of sale shall be interpreted subject to the purchaser's rights under the NZ Consumer Guarantees Act 1993, with the intent that no provisions shall in any way limit the buyer's rights under the Act.
Errors or Omissions The seller is entitled at any time to correct all errors and omissions in any advertising, quotation, pricing, invoice or acknowledgement. While our best efforts are made to keep our stock levels, and pricing accurate we cannot be responsible for any errors in stock levels and pricing.
Description of Products The seller relies on availability of supply of certain inputs to meet the product descriptions. Product descriptions are subject to change if supply availability changes. Some changes may be considered immaterial to the performance of the product and not result in model changes. In such case, stock of a single model may be made up of slightly different product than described on the Antipodes Audio website. Descriptions, illustrations and literature are therefore not binding on the seller. If the goods do not match the description on the seller's website to the satisfaction of the buyer, the buyer should inform the seller immediately to organise a refund, and return of the product. A full refund shall be sufficient remedy.
Delivery The seller reserves the right to dispatch the buyer's order in one delivery or by installments. Any quotations of delivery times by the seller are made in good faith but are estimates and the seller shall not be bound by such quotation. All shipping is ex New Zealand and the seller is not responsible for taxes levied outside of New Zealand. The buyer is responsible for local Customs clearance and related costs, including duties, taxes and excises, and brokerage and storage fees. Otherwise, Antipodes Audio will meet freight costs of delivering purchases of new product to the customer. Some exceptions may arise where delivery costs are unusually high and shall be notified to the buyer before shipment.
Out of Stock Products & Backorders If a product is ordered but later found to be out of stock the seller reserves the right to put the order on back order and confirm a suggested ETA with the customer. The customer may ask Antipodes Audio to either provide an alternative product, with the customer paying price differences if the cost is higher, or the difference will be refunded by Antipodes Audio to the customer if the cost is lower. If the customer instead wishes to cancel the order then Antipodes Audio will offer a full refund to the customer.
Returns Unless otherwise agreed, all sales of new cables come with a 60 Day Money Back Guarantee, and all other sales come with a 30 Day Money Back Guarantee. The 'money back guarantee period' begins when the customer receives the product and ceases when the customer ships the product back to Antipodes Audio. Antipodes Audio will not strictly enforce the 'money back guarantee period' but will expect all reasonable efforts to be made to return the product in a timely fashion. Any return, for any reason within our 'money back guarantee period' will receive a full refund, provided the product is returned with no material damage, and if other damage is consistent with reasonable use during the 'money back guarantee period'. Where damage is assessed by Antipodes Audio to be unreasonable, then the refund will be reduced by an amount solely determined by Antipodes Audio. The fact that a customer has kept the product beyond the 'money back guarantee period' shall be evidence that the product has met the expectations of the customer. Returns outside of the 'money back guarantee period' will be accepted under the warranty, where the goods have failed due to manufacturing fault within the warranty period. Any other returns have to be agreed with Antipodes Audio before being sent.
Faulty Returns And Warranty All Antipodes Audio cables have a 3 year warranty for manufacturing defects, and other products have a 1 year warranty for manufacturing defects. Antipodes Audio considers that its products are sold as high performance, delicate, specialist items sold solely for careful use in high end audio systems, and that its products are not designed to withstand liquid damage, stretching, excessive heat, twisting, crushing or bending. Antipodes Audio emphasizes that due to the unique construction (specifically the fabric insulation), stretching of the cables is very likely to result in the signal wires snapping, often rendering the cable a write-off. When wires have snapped along the body of the cable, as opposed to inside the connectors or at the junction with the connectors, the cables will not be repaired under warranty and will be repaired for a fee determined by Antipodes Audio. The warranty period will apply from the date the product is shipped to you and as evidenced by a printed document accompanying the cables when shipped. Please contact Antipodes Audio before returning any goods.
Fault Repair and Replacement All fault repairs are performed by Antipodes Audio in New Zealand. Replacements will be shipped promptly, but repairs may take two or more weeks, as repaired cables will need to go through our conditioning process to be equivalent in performance to a new cable, and other products may need parts to be imported. Products outside of the warranty period or not covered due to mistreatment will be subject to charges determined by Antipodes Audio but will be given equal priority to any other repairs.
Shipping of Faulty Products or Returns The shipping or delivery of items for return to Antipodes Audio is the responsibility of the customer. Where the return is due to Antipodes Audio sending incorrect or faulty product then Antipodes Audio will refund the customer’s actual freight costs, or organise courier pickup from the customer, at the election of Antipodes Audio. In the case of returning cables under the 'money back guarantee period', the customer must adequately pack the item, send it via a reputable air freight service, and meet the freight costs. Antipodes Audio is not liable to make a refund under the 'money back guarantee period' unless and until the item has been delivered to Antipodes Audio and its condition has been assessed. Appropriate refunds will be issued promptly and usually within one business day of the item’s return. When the return is under warranty then standard RTB (return to base) procedure will apply - which means the customer is entirely responsible for returning the goods to Antipodes Audio and for associated costs, and Antipodes Audio is entirely responsible for returning the goods to the customer and for associated costs.
Seller's Liability and Maintenance Guarantee The buyer shall ensure that the goods ordered are fit and suitable for the purpose for which they are required before purchasing and the seller is under no liability if they are not. The warranty does not cover damage from misuse, accident, negligent, inappropriate or improper operation, maintenance, installation, modification or adjustment. The seller's liability under this contract and the warranty is confined to the original buyert, it being agreed that the seller has no liability to any purchaser of the goods from the buyer in that the buyer's rights under the contract are not assignable without the prior written consent of the seller.
